These Terms of Service (“Terms”) govern your use of the Messame mobile application and related services (collectively, the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App. 1. Description of the Service Messame is a mobile application that allows users to create, store, and manage text notes, files, images, and other media. Your data is stored and synchronized through Apple iCloud, which is managed by Apple Inc. We do not host or store your personal data on our own servers. Some features of the App are available for free, while others require an in-app purchase to unlock (for example, creating more than three folders). 2. Eligibility You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the App. If you are under 18, you must have permission from a parent or legal guardian. 3. Account and Authentication Messame relies entirely on your Apple ID for authentication and synchronization. We do not create or store separate Messame user accounts, passwords, or credentials. You are responsible for maintaining the security of your Apple ID, device, and iCloud settings. We are not responsible for unauthorized access to your data through your Apple account or device. 4. Data Storage and Responsibility All notes, media, and other user content you create in Messame are stored solely in your personal iCloud account. We do not have access to or control over that content. Apple’s handling of your iCloud data is subject to Apple’s own terms and privacy policy, available at: https://www.apple.com/legal/privacy/ You are solely responsible for maintaining backups and ensuring iCloud functionality. 5. Intellectual Property The Messame App, including all design elements, code, graphics, and branding, is the property of Picture It Production Oy and is protected by international copyright and intellectual property laws. You retain ownership of all content you create or store using the App. You agree not to copy, reverse engineer, distribute, or modify any part of the App without written permission from Picture It Production Oy. 6. In-App Purchases Messame offers optional in-app purchases handled securely through Apple’s App Store. Apple manages the payment process, and we do not have access to your billing details. All purchases are subject to Apple’s applicable terms and refund policies. 7. Prohibited Uses You agree not to: Use the App to upload or distribute unlawful, harmful, or infringing content. Attempt to disrupt or interfere with the App or related systems. Use the App in violation of applicable laws or regulations. 8. Third-Party Services The App may include limited integrations with Apple or other third-party technologies necessary for its functionality. Messame does not use third-party analytics, advertising SDKs, or tracking libraries beyond Apple’s own App Store Connect metrics (which are aggregated and anonymized). We are not responsible for the practices or content of any third-party services linked through the App. 9. Disclaimer of Warranties The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We make no guarantee that the App will be error-free, uninterrupted, or that data stored through iCloud will be secure or retrievable at all times. 10. Limitation of Liability To the fullest extent permitted by applicable law, Picture It Production Oy, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or goodwill, arising from or related to your use of the App. In no event shall our total liability to you exceed zero (0) euros (EUR) or the minimum amount required by law, whichever is greater. 11. Termination You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms or engage in harmful or unlawful behavior. 12. Changes to the Terms We may update these Terms from time to time. When we do, we will update the “Last updated” date. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. 13. Governing Law and Jurisdiction These Terms are governed by the laws of Finland, without regard to conflict-of-law rules. However, users in other jurisdictions retain any mandatory consumer rights under their local laws. If any dispute arises, it shall first be attempted to be resolved amicably. Failing that, disputes may be brought before the competent courts of Finland. 14.
